Amano Europe attaches great importance to the protection of your privacy.
When processing your personal data we do respect the applicable legal provisions. Processing of personal data occurs in accordance with European legislation (the General Data Protection Regulation or GDPR) and where applicable any other relevant privacy regulation.
Personal data includes any information regarding an identified or identifiable natural person like for example your name, contact details and any other information or documents that allows you to identify yourself as a natural person.
Through this Privacy Policy we inform you about our policy to protect your privacy when processing your personal data and your rights as a data subject.
The person responsible for the processing of your personal data is AMANO Europe NV, with registered office at Westerring 2 - 3600 Genk, Belgium, and Belgian company number (CBE) 0434.751.030.
We may collect information about you in a variety of ways. The information we may collect via the App depends on the content and materials you use, and includes:
Your data
We collect and store all personal information related to your App profile, which you provide to us either upon sign-up or through continued use of the App, for example:
- First and last name
- Email address
- License plate number
- Location and Time zone
- Photos
Derivative data and uploaded media
Further, we may collect information that our server automatically collect when you access the App, such as native actions that are integral to the App, actions taken when creating entries, data collected from the mobile device hardware, such as -but not excluded- GPS location data, editing entries and uploading media to the App. As such, we may also request access to your device’s photo roll or camera in order for us to upload your media to the App. Any media uploaded in this fashion, will be collected and stored on our servers. If you wish to change our access or permissions, you may do so in your device’s settings.
We may collect the data detailed above in different ways:
· When you voluntarily provide us with such data: meaning for example, if you are a user of the App and you register to our Services and create an account through our site.
· Data collected automatically: meaning, if you use our mobile application, we may by use of software interfaces, cookies and other similar technologies gather information automatically, such as your unique identification number, IP address, etc. We may also acquire information from other trusted sources to update or supplement the data that we collect automatically.
· We may also collect personal information from third parties, such as partner companies with whom we interact to provide you the Services available in the App, or public available sources.
We process your personal data for various purposes. We will only process those data that are relevant to achieve the purpose in question.
Generally, and by way of example, we use your personal data:
· When we have received your specific permission:
o When you register voluntarily in the App;
· In the context of the performance of the contract:
o Eg. concluding, managing and executing contracts that are part of the Amano range of Services available through the App;
· To observe all legal and regulatory obligations incumbent on us, in particular:
o Tax or accounting obligations ;
· For reasons related to our legitimate interest. In this case, we ensure that we maintain a fair balance between our legitimate interest and respect for your privacy:
o Prevention of abuse and fraud;
o Protection of the company's goods;
o Supervision of the regularity of transactions;
o Monitoring and control of buildings and car parks;
o Determining, exercising, defending and protecting our rights or the persons we may represent, for example in the event of disputes;
o Search for evidence that allows to manage complaints (e.g. locate a vehicle that is not found).
By providing personal data, the data subject grants explicit permission to process that data for the purposes based on consent. The data subject has the right to withdraw the consent given, provided that the processing is based solely on the data subject's consent.
Information relating to you may, where appropriate, be passed on to representatives or correspondents of companies involved in the provision of the Services as controller or processor. We only pass on your data to service providers if it appears necessary to offer the services in our name or to comply with legal requirements. We require under a contract that these service providers protect the confidentiality and security of the personal information they process on our behalf (see also 5.2 below).
We may disclose some personal information we collect to companies of the Amano group for the purpose of processing the transactions and other services that you have used, in accordance with the provisions of this Privacy Policy or in the manner indicated at the time we collect the data.
We undertake not to sell and only disclose the personal information we collect about you in the cases described in this statement or in any other document we send you at the time we collect the information.
We also transfer your data to other persons if we are obliged to do so under a contractual or legal obligation or if a legitimate interest justifies it (e.g. to defend our interests).
General
For some services, we call on specialized partners who act as processors and who are contractually associated with us.
Amano ensures that these "processors":
· Have only the information necessary to perform their duties, and
· With regard to Amano, make a commitment to, on the one hand, process this data confidentially, and on the other hand, to use it only to perform their tasks.
· Are carefully selected to ensure that they, and their related entities who may access your personal data, provide your data with equal protection to that stated in this privacy policy and required by applicable privacy laws and the Platforms Provider’s rules, policies and guidelines.
Types of processors
We call on some specialized processors, such as:
· Intermediaries or partners with whom we work;
· Service providers in the field of IT and other technical services;
We do not process or transfer your personal data outside the European Economic Area (EEA), unless the location of the Services that are provided through the App are located outside the EEA.
We will retain your information for as long as you remain an active user of your account, for the statutory limitation period and for any other retention period as required by applicable laws and regulations.
You can control our data use through your account settings:
· You can limit how your information is visible for other users of the Services through your privacy settings;
· You can limit the notifications you receive from us, using you notification settings; and
· You can revoke the access of third-party applications that you previously connected to your Amano account, using your application settings.
· You can delete your information and all your related transaction data by using the delete function build in the App. Evoking this function will delete all data associated with your account, including your account. This action is permanent and cannot be revoked.
· In accordance with applicable regulations your transaction data will be kept by default no longer than one year after completion of the registration in an active database. After this period the transaction data related to your account will be kept for 4 years as a backup. All transaction data related to your account older than 5 years will be deleted automatically.
In accordance with applicable regulations, you have a legal right to request free access to your personal data in order to view, supplement, correct, amend, delete or transfer it on request.
More specifically, the data subject has the following rights in accordance with applicable regulations and under applicable conditions:
Right to ACCESS & RECTIFY: the data subject always has the option of accessing and rectifying his personal data and the storage period as a function build in the App.
Right to DELETE: the data subject has the option, under certain conditions, to request the removal of his personal data, including historical data, as a function build in the App.
Right to TRANSFER DATA: the data subject has the option of obtaining his personal data in a structured, common and machine-readable form and transfer it to third parties, as a function build in the App.
Right to be FORGOTTEN: the data subject is assured that all transaction data older that 5 years after registration will be deleted.
Right to be NOTIFIED: the data subject is assured that in case of eventual breach of his personal data will be notified in the App and alternatively, when available, by email.
If you wish to exercise any of these rights listed above, you can use the build in functions in the App for this purpose.
